Terms of Service

Effective October 10, 2026.

By using Phosphene you agree to these terms. They are short on purpose.

What Phosphene is

Phosphene is an experiential light app for entertainment and personal exploration. It is not a medical device, and it does not diagnose, treat or prevent anything. Nothing in it is medical advice.

Please read: photosensitivity

Flashing light can trigger seizures in people with photosensitive epilepsy and can provoke migraine. Do not use Phosphene if you have photosensitive epilepsy, or if you are not sure whether you do. If you are unsure, check with your doctor first. You must be 18 or older.

Use it with your eyes closed, somewhere safe. Do not drive or operate machinery or anything else that needs your attention while you use it. Stop at once if you feel unwell or uncomfortable: tap the screen, press any key or close the app.

Free beta, and premium later

Phosphene is free while it is in beta. We may add paid premium features later, including the Embers community page.

Community and your content

Embers, chat and journals are not open yet. When they are, we will add community rules and say what happens to anything you post. This section is a placeholder.

No warranty

Phosphene is provided "as is" and "as available", without warranties of any kind, express or implied. We do not promise that it will work on every device, be uninterrupted, or produce any particular experience.

Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential damages, or for any loss or injury arising from your use of Phosphene. You use it at your own risk and your own choice.

Changes

We may update these terms and will post the new version here with a new date. Continuing to use Phosphene after a change means you accept it.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, USA (to be confirmed).
